Terms and conditions for 100cards App

Please read the following terms and conditions which apply to your use of the 100cards app in Beta Testing.
These terms apply to your use of 100cards (referred to in these terms as 100cards, 100cards app or app), including any services or functionality accessed through 100cards. The 100cards service is provided by Santander Digital Assets, S.L Santander Digital Assets, S.L. (“SDA”) is a Spanish company, affiliated of Banco Santander, S.A., with Tax ID. No. B-88359757, and registered offices at Madrid, Avenida de Cantabria, s/n, CP: 28660, Boadilla del Monte, Spain.
Your use of any of the services offered through 100cards is subject to these terms and conditions. By installing the 100cards app and registering to use our services, you agree to be bound by these terms and conditions. If you do not agree to these terms you should not install the 100cards app or use our services. The language of these terms and conditions are in Spanish and communication with you will be in Spanish.
100cards app enables you to have all your information from your credit cards and bank accounts in one easy app ensuring you’re always in control. With our technology, we will analyse your data and provide you with relevant insights. We are here to try and make it easier for you to manage your credit cards and bank accounts. 100cards provides information only and not financial advice.
100cards takes data security very seriously, which is why all of your financial information that we process is transmitted through secured protocols using the most advanced cryptographic protocols such as TLS1.2. This means our software is designed to add an extra layer of security to your information. Also, all the information stored in the device is kept secured in the secure storage, therefore, 100cards won’t store any bank credentials and they will be safely encrypted and stored in a trusted partner.

Accessing 100cards services
To use 100cards (including any services accessible through 100cards), you must first register to set up an account with us by completing the registration process through the 100cards app.
To register, you must be at least 18 years of age.
To register, you must provide your full name, email address and mobile phone number. You acknowledge and agree that the information provided by you to us is true, accurate and correct. You are responsible for the accuracy of the information you provide to us. You must promptly update your registration details in the event of any changes to your details. You can do this in the app or by sending an email to firstname.lastname@example.org.
Keeping your account safe:
When you create an account at 100cards a passcode will be sent to your mobile phone number which you will use to log in.
Whenever you want to log in to your 100cards account, you will have to add your personal ID number (PIN) created for these purposes, or alternatively, identify yourself using the established biometric element.
100cards only allows the user to be logged-in on one device at a time due to security reasons.
You are responsible for all activities that occur using 100cards on your device. Any login details you create in relation to your account are for your own personal use only and you must keep your login details confidential and secure. Sharing your login details with any other person is strictly prohibited. If you have lost your device, let us know by sending an email to email@example.com and we will log you out on your behalf.
100cards app enables you to access all your credit card and bank account information in one easy app ensuring you’re always in control. The services we offer in the app are:
- Your Credit Cards overview: an aggregated view of all of your credit cards you have connected to the 100cards app (credit card name, amount spent on the credit card, the amount available in the bank account, transaction list, etc.)
- Your bank accounts overview: an aggregated view of all of your bank accounts you have connected to the 100cards app ( bank account name, the amount available in the bank account, transaction list, etc.)
- Relevant insights and alerts: analysis of your credit card and bank account data and transactions to offer you valuable insights and alerts.
We shall not charge you to use the 100cards app.
To the extent we are required to make communications to you, we shall communicate messages to you via an in-app notification, text message or, if you have provided one, to your email address.
In the event of suspected fraud or unauthorized access, we shall contact you using the contact details you provided to us during the registration process.
Connecting and updating your Credit Card and Bank Account to 100cards
To use our services, you must link one or more credit cards to your 100cards account. To link a credit card and/or a bank account, we will automatically download transactional information relating to your credit card(s) and bank account(s) and continue to do so at certain times until you withdraw your consent for it to do so. We will only access to a ‘screen grab’ of your credit card(s) and bank account(s) transaction information and we will not seek to obtain any other information or initiate any payments.
In order to link a credit card account and/or a bank account we:
- require certain financial account details from you including your security credentials relating to that credit card account and bank account (such as usernames, access numbers, passwords, security questions and answers, etc.). These details are needed in order to access and collect information from your financial account provider; and
- require your consent to retrieve the information from your financial institution. This consent will be requested at every connection.
Any security credentials you provide relating to one of your financial accounts will be collected, held and stored securely. We will not make your security credentials available to any third party other than your financial account provider and will only transmit them through safe and efficient channels in accordance with applicable law and regulation. We will not at any time store your security credentials in the 100cards app or in any other place.
Any financial account data that you provide, and any information obtained from your linked financial accounts, shall only be used by us to enable us to provide the services to you and, if necessary, to ensure the proper functioning of the services.

Closing your 100cards account
These terms apply for as long as you have a 100cards account with us. If you want to close your account, you can do it from 100cards app.
Changing or ending 100cards and the services
We are currently offering the 100cards app to you as part of our Beta Testing. This means that we are testing the features and functionality of the app and may make regular changes to the way the services look, feel and work. We may make changes to the 100cards services or end the provision of the 100cards app and services at any time without notice, although we will try to give you notice where possible.
We may suspend or end your use of 100cards app and/or the services at any time with or without informing you. If we suspend or end provision of the 100cards app, we have no obligation to resume provision of the 100cards app or the services.
We provide the 100cards app and the services within the app “as is” and we have no liability to you or any third party for any loss or damage resulting from your access or use of 100cards. We do not warrant that 100cards app (or any of its content) will be uninterrupted or error free and whilst we endeavour to ensure the content, information and materials within the app are accurate and error free we cannot guarantee the accuracy, validity, completeness or currency of the information. Nothing in these terms and conditions exclude or limit our liability for death or personal injury arising from our negligence, fraud or fraudulent misrepresentation or any liability that may not be excluded according to your local law.
All information, content and material displayed on 100cards app is provided for information only. Never take any of the data, alerts, app content or other communications we send or make available to you as financial advice or as a personal recommendation. You agree that, by using our Services, you are responsible for your own financial decisions. We recommend seeking professional advice if appropriate.
You cannot transfer your rights or obligations, under these terms and conditions, to anyone else.
We may transfer our rights and obligations under these Terms to another organization by giving you advance written notice
We may use other third-party companies to help us with our services to you. We take all reasonable steps to make sure that the people, and companies, we work with are competent to do the job. But we are not responsible for their actions and/or failure to provide services. You agree that we may provide information such as the email address to them in order to keep the correct functionality of the service.
No one else has any rights under the agreement and no other person has any rights to enforce any of its terms.
Each of the paragraphs of these terms and conditions operates separately. If any court, or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Any delay on our behalf to enforce these terms and conditions should not be interpreted as permission to breach them and will not prevent us from taking action at a later date.
If the provision of support for the service is delayed by an event outside our control then we will contact you as reasonably practicable to let you know and we will take steps to minimize the effect of the delay. Provided we do this we will not be liable for delays caused by the event.
These terms are governed by Mexican law and you can only bring legal proceedings in respect of these terms, or the services we provide in the Mexican courts. Nothing in these term affects your right as a consumer to rely on any mandatory provisions of your local law, nor to file claims with your local competent courts which jurisdiction may not be waived.
Intellectual property rights
All intellectual property rights in any content of 100Cards (for example, the content in our app and on our website, our logo and designs) are owned by us or our licensors. Except as expressly set out here, nothing in these terms gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from the Site. You must not use our intellectual property as your own. You also must not reverse-engineer any of our products (that is, reproduce them after a detailed examination of their construction or composition).
Service suspension and termination
We may, from time to time, with or without prior notice, temporarily suspend the operation of any Service and/or the Site (in whole or in part) for repair or maintenance work or in order to update or upgrade any content, features or functionality.
Without prejudice to our rights and remedies, we reserve the right to promptly disable your login details and suspend access to the service, if in our reasonable opinion, we believe that you have breached any of the provisions of these terms.
These terms will continue to apply until terminated by either party. We may, with or without prior notice, suspend and/or terminate any Service and/or your use of your account in the event that you have breached any of these terms.
If you have breached these terms or we reasonably suspect you have breached applicable law, we may take such action as we deem appropriate. Such a breach by you may result in our taking, with or without notice, all or any of the following actions: issue of a warning to you; immediate, temporary or permanent withdrawal of your right to use any Service; legal proceedings against you for reimbursement of all recoverable loss and damage resulting from the breach; and/or disclosure of all relevant information to law enforcement authorities as we reasonably feel is necessary.
The responses described above are not limited, and we may take any other action we deem appropriate.
Upon termination of your account, for any reason, all rights granted to you under these terms will immediately cease, we will delete any information we hold and you must promptly discontinue all use of the Service.
What you are not allowed to do
Except to the extent expressly set out in these terms, you are not allowed to: ‘scrape’ content or store content of the 100Cards app and Site on a server or other storage device connected to a network or create an electronic database by systematically downloading and storing all of the content of the Site and 100Cards app; remove or change any content of the Site or attempt to circumvent security or interfere with the proper working of the Site or the servers on which it is hosted; or create links to the Site from any other website, without our prior written consent, although you may link from a website that is operated by you provided the link is not misleading or deceptive and fairly indicates its destination, you do not imply that we endorse you, your website, or any products or services you offer, you link to (and do not frame or replicate) the home page of the Site, and the linked website does not contain any content that is unlawful, threatening, abusive, defamatory, pornographic, obscene, vulgar, indecent, offensive or which infringes on the intellectual property rights or other rights of any third party.
You must only use the Services and anything available from the Site for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any of our affiliates.
All rights granted to you under these terms will terminate immediately in the event that you are in breach of any of them.
Access to the Services
We may, from time to time, restrict access to certain features, to users who have registered with us. In particular, we reserve the right to disable your account at any time, if in our opinion you have failed to comply with any of the provisions of these terms or if any details you provide for the purposes of registering as a user prove to be false.
We cannot guarantee the continuous, uninterrupted or error-free operability of the Service. There may be times when certain features, parts or content of the Site, or the entire Site, become unavailable (whether on a scheduled or unscheduled basis) or are modified, suspended or withdrawn by us, in our sole discretion. We will use our reasonable efforts to provide you notice when the Site and/or Service is to be unavailable or when we are modifying, suspending or withdrawing the Services but in some instances particularly where there is a security, or data breach threat or we are required by law, this may not be possible. We will give you notice if we decide to terminate provision of the Services on any Application or the Website.
